Terms & Conditions

These terms and conditions, alongside the Privacy Policy, will apply when you subscribe to or place an order with Equestrian Pilates. You are entering an agreement to purchase a subscription to videos (“services”) or good/s (“goods”) subject to these terms and conditions. 1.0 Acceptance of Terms

Your use of Equestrian Pilates’ site is subject to, and acceptance of without any modification, the Terms and Conditions contained herein. Please read these terms, because they contain important information which applies to you. If you do not agree to these terms of use, please refrain from using our site.

2.0 Changes to this policy

Equestrian Pilates’s Terms and Conditions may change at any time and will be posted on this page and, where appropriate, notified to you by e-mail. We therefore advise you to read this page every time you visit our website.

3.0 Intellectual Property Rights / Copyright

Equestrian Pilates is the owner of all intellectual property rights in our site and with regard to all material, attributable to Equestrian Pilates, published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. No images, videos, logos, trademarks, video content and names used on this site are to be reproduced.  Your subscription to this site does not permit the reproduction of any information contained herein.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

4.0 Prohibited Use of Subscription

4.1 Once subscribed, you will be provided with a unique user account and password, which you must treat as confidential and must not disclose to any third party. Equestrian Pilates have the right to disable any user account if Equestrian Pilates believes you have failed to comply with any part of these terms and conditions. If Equestrian Pilates believe site access has been compromised new user accounts and passwords will be issued.

4.2 By subscribing to Equestrian Pilates Membership you accept the condition of use of this site is for personal, individual use only.  Your subscription does not entitle you to use the content for commercial purposes, for example viewing by a club or group. Such misuse will result in immediate termination of your account without refund.

4.3 Equestrian Pilates monitor usage of accounts and usage of the Site that is greater than the norm will be investigated by Equestrian Pilates for possible fraudulent use.  Where fraudulent use is suspected then your account will be suspended immediately. If your account is suspended, then you have 14 calendar days to appeal against the decision in writing/e-mail to Equestrian Pilates.  Successful appeal will result in your account being re-activated and any lost subscription rolled-over.  Failure to appeal or an unsuccessful appeal will result in account termination without refund. In all cases Equestrian Pilates’ decision is final.

5.0 Using Our Service

5.1 By subscribing to Equestrian Pilates’ you are confirming that you fully understand that Pilates is a form of physical exercise and as with all physical exercise you acknowledge that by undertaking the Equestrian Pilates exercise programme you are exposing yourself to the risk of injury: you hereby agree to voluntarily accept and assume any and all such risks as well as any risks not mentioned herein that are in any way associated with subscription. You agree that by participating in physical exercise or training activities you do so entirely at your own risk.

5.2 We advise you to seek a medical examination from your Doctor prior to participating in any new exercise programme.

5.3 By accepting our terms, you voluntarily assume any and all risks, known or unknown, associated with your use of the Service.  You acknowledge that your participation may present certain risks, and hereby assume any and all risks associated therewith, including, without limitation, the risk of physical or mental or emotional injury, minor and/or severe bodily harm, death, and/or illness, which arise by any means, including, without limitation: acts, omissions, recommendations or advice given by the Released Parties.

5.4  It is your responsibility to ensure the environment in which you choose to exercise is safe and free from hazards and that all equipment you choose to use is safe and free from defects.

5.5 You must exercise within your own limitations: you should not exercise through pain:  pain is the body’s warning system and it should not be ignored.  If you are feeling tired and/or unwell we advise that you do not exercise until the symptoms have subsided.

5.6  By accepting these terms and conditions you explicitly agree to release and discharge the Equestrian Pilates instructor and each of their respective parents, subsidiaries, related and affiliated companies, licensees, and the directors, officers, employees, agents contractors, partners, representatives and members of the foregoing entities or other persons affiliated with the Sites (the “Released Parties”) from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the Released Parties for personal injury or property loss.

6.0 Pregnancy

Equestrian Pilates does not recommend performing the online Pilates exercises if you are pregnant; we recommend you contact a Pilates Instructor who is able to teach you face to face.

7.0 Equestrian Pilates Site Access

7.1 When you access the Equestrian Pilates site, Equestrian Pilates only process and retain information about you in accordance with our Privacy Policy.

7.2 Please ensure that your computer and broadband connection is suitable for video downloading, because Equestrian Pilates cannot be responsible for the quality of the end user’s facilities.

8.0 Subscription

8.1 Accurate information is important so please take the time to check your subscription details. If you provide information that is untrue, incomplete or inaccurate or Equestrian Pilates have reasonable grounds to doubt that such information is such, then we reserve the right to suspend or terminate your account and to refuse use of our Services.

8.2 Our site is not aimed at those under the age of 18 years of age, and when you provide Equestrian Pilates with your subscription information you are confirming that you are over this age limit and as such are of a legal age to form this binding contract, under the laws relevant to your jurisdiction.

8.3 When your subscription is accepted Equestrian Pilates will confirm this in writing to the e-mail address specified by you in your subscription. At this point these Terms and Conditions will become binding on you and Equestrian Pilates.

8.4 As detailed in subscription process you will be able to subscribe to Equestrian Pilates’ site by:

8.5 Equestrian Pilates’ subscription charges may vary and Equestrian Pilates will notify all service users 4 weeks prior to any charge variations. Equestrian Pilates will not alter charges before the end of a subscription agreement and will not apply them to previous payments.

8.6 Subscription charges must be received by Equestrian Pilates in cleared funds on their due payment date; Equestrian Pilates may suspend Services to you if you fail to meet the payment date. Equestrian Pilates will contact you prior to taking any action.

9.0 Updates to Our Site

9.1 We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely: should this occur your subscription will be refunded on a pro-rata basis. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

9.2 We may need to suspend the Services if we have to deal with technical issues, or to make improvements to our site. We will endeavour to contact you in advance where this occurs, unless the technical issue is outwith our control. If our Services are suspended due to a technical issue with our site which we do not resolve within 48 hours, of being aware of the problem, we shall make appropriate refunds to you strictly relating to the period in excess of the first 48hr of the Services being suspended. Refunds will be for whole, 24hr, days only.

10.0 Cancellations

You may cancel your subscription as follows:

11.0 Events Outside Our Control

11.1 Equestrian Pilates will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control.  An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

11.2 If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:
(a) we will contact you as soon as reasonably possible to notify you; and
(b) our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

12.0 Reliance on Information Posted

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

13.0 Liability

The information, services and products on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the maximum extent permitted by applicable law, Equestrian Pilates, their personnel, and third parties connected to us hereby expressly exclude:

14.0 Linking to Our Site

14.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
14.2 Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out above.

15.0 External Links

Where our site contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.  When accessing a site via our website we advise you check their terms of use and privacy policies to ensure compliance and determine how they may use your information, because they will not be Equestrian Pilates policies.

16.0 Viruses, hacking and other offences

16.1 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

16.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

16.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

17.0 Changes to our Terms & Conditions policy

Any changes we may make to our Terms and Conditions policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. However, we advise that you check this page regularly to keep up to date with any necessary changes.

18.0 Jurisdiction and Applicable Law

18.1 The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site, our Terms or any Contract although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

18.2 Our terms of website use, our Terms, any Contract and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
